Work Place Injury and Third Party Liability Claims

A common misunderstanding is that an injured worker is only able to collect workers’ compensation benefits and nothing more. This is not always the case. In certain situations, a party other than your employer may be legally responsible for causing a work-related accident. This is known as a third-party liability claim and is separate from the workers’ compensation claim.


Third-party liability claims typically arise out of construction site accidents. Examples of responsible third­parties may include the general contractor, a sub-contractor (who is not your direct employer) or a property owner. You are also eligible to bring a personal injury claim against an employer who does not have workers’ compensation insurance.
